A. Cancellation Policy

Introduction

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession:

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (SeniorBad GmbH, Grenzstr. 11a, 01936 Laußnitz, Deutschland, Tel.: +4935795179600, Fax: +4935795179699, E-mail: info@seniorbad.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online on the website at the internet address https://www.seniorbad.de/Online-Widerrufsformular. If you use this online function, we will communicate to you without delay, on a durable medium (e.g. by e-mail), an acknowledgement of receipt containing information on the content of the withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

We will bear the cost of returning goods which, by their nature, can normally be returned by post. You will have to bear the direct cost of returning goods which, by their nature, cannot normally be returned by post (goods shipped by freight forwarder); this cost is estimated at a maximum of approximately 89 euros for each such item.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not nationals of a Member State of the European Union and whose sole place of residence and delivery address are located outside the European Union at the time the contract is concluded.

Linked/financed transactions

If you finance this contract by means of a loan and subsequently withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is to be assumed in particular if we are also your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been paid to us when the withdrawal takes effect or when the goods are returned, your lender assumes our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign currency or derivatives). If you wish to avoid being contractually bound as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are entitled to a right of withdrawal for that agreement as well.

General information

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
2) Please do not return the goods to us carriage forward (postage unpaid).
3) Please note that the aforementioned points 1-2 are not a precondition for the effective exercise of the right of withdrawal.
